Originally the new state’s constitutions foundation was based off the thirteen colonial charters (Bowman & Kearney, 2011, p56). According to Bowman & Kearney (2011), â€Å"All state constitutions both distribute and constrain political power among groups and regions† (p. 55). In that such provide the basic and key components for government to allow for an even distribution of power for the three branches, while offering protection for individual rights. â€Å"Constitutions represent the fundamental law of a state, superior to statutory law. Only the federal Constitution and federal statutes take priority over state constitutions† (Bowman & Kearney, 2011, p. 55). Over the course of many years the state’s constitutions have been slowly amended to meet the needs of a growing governmental body. The current Texas constitution was created in 1876 and is composed of a preamble followed by 17 articles, â€Å"to include Bill of Rights, Legislative Department, Executive Department, and Judicial Department† (The University of Texas School of Law: Tarlton Law Library: Jamail Center for Legal Research, 2013). Article I of the Texas constitution is the Bill of Rights. It is in this article that individual rights are outlined for citizens in which the government cannot overlook under any given circumstance. Upon reading the Texas Constitution, the impression is given that religious freedom and for no man to be unjustly persecuted by the hand of the government pose to be the most important feature detailed in the Bill of Rights. Just like the United States Constitution there are limitations to the freedoms being granted in this portion of the Texas document (The University of Texas School of Law: Tarlton Law Library: Jamail Center for Legal Research, 2013). In replica of the United Stated Constitution, state level constitutions are sculpted after the federal government in which it delegates power throughout three branches of government: executive, legislative, and judicial (Bowman & Kearney, 2011, p.27). Article III of the Texas Constitution writes the legislative department; section 1 states that, â€Å"The legislative power of this State  shall be vested in a Senate and House of Representatives, which together shall be styled â€Å"The Legislature of the State of Texas† (The University of Texas School of Law: Tarlton Law Library: Jamail Center for Legal Research, 2013). Sections 2 through 7 details the composition of the legislative department to include the House of Representatives and the Senat e and also states the qualifications for such positions. The Senate entails thirty-one members and is prohibited to exceed such limit. The House of Representatives is comprised â€Å"of 93 members until the first apportionment† (The University of Texas School of Law: Tarlton Law Library: Jamail Center for Legal Research, 2013) then it may increase by ratio not to exceed 1 representative per 15,000 inhabitants. However the numbers are to never surpass 150 members. The remainder sections write the limitations of the legislature power, details processes, and conditions the expectations in regards to the conduct of each official (The University of Texas School of Law: Tarlton Law Library: Jamail Center for Legal Research, 2013). In the State of Texas, the Legislative Branch is granted the most powers in writing. One can find supporting evidence to the fact after a complete examination is done of this document. A conclusion can be drawn that as a result of all powers given, this branch is able to have a limited amount of regulation over the other two branches of government. Also, it is here that bills of law are p assed to ensure the necessary provisions stated in other articles are upheld. The power of the executive branch is amalgamated from the office of the governor (Bowman & Kearney, 2011, p. 68). Historically, the executive branch held increasingly more power and stature resulting from constitutional amendments allowing for governors to be elected by popular vote. (Bowman & Kearney, 2011, p. 59). Such unbalance in power eventually led to the people giving governors higher authority to veto legislative bills and granted longer terms. This trend continued through the early 1800s, 1830s and 1840s however, somewhat ended during the Jacksonian Era due to â€Å"the Jacksonian principle of popular elections to fill most government offices resulted in a fragmented state executive branch.† (Bowman & Kearney, 2011, p. 59). Within the Texas Constitution the executive branch powers can be found in Article IV, â€Å"The Executive Department† (The University of Texas School of Law: Tarlton Law Library: Jamail Center for Legal Research, 2013). The Executive Department must contain â€Å"a governor, lieutenant-governor, secretary of  State, comptroller of public accounts, tr easurer, commissioner of the land of office and attorney general† (Ericson & Wallace, 2010). Throughout the remainder of the article, elaboration of the rights and responsibilities of each member is outlined (The University of Texas School of Law: Tarlton Law Library: Jamail Center for Legal Research, 2013). The Judicial Branch power is bestowed in a supreme court, courts of appeal, district courts, and various other courts as authorized by the state’s constitution. Usually the state’s judicial branch is headed by the state Supreme Court who tries cases from courts of lower levels (Bowman & Kearney, 2011, p.68). Article V from the Texas Constitution includes the powers of the Judicial Department to be vested in â€Å"one Supreme Court, in a Court of Appeals, in District Courts, in County Courts, in Commissioners’ Courts, in Courts of Justices of the Peace, and in such other courts and may be established by law† (The University of Texas School of Law: Tarlton Law Library: Jamail Center for Legal Research, 2013). The head of the Supreme Court is governed by a chief justice and two associate justices. With further reading, the rules and regulations for the court justices and order of operations can be found written in the sections of this article (The University of Texas School of Law: Tarlton Law Library: Jamail Center for Legal Research, 2013). In conclusion, many amendments have been made to reflect the needs of a growing population all through history. Conferring with Bowman & Kearney (2011), â€Å"constitutional revision must be an ongoing process if the states are to cope with the changing contours of American society and stay in the vanguard of innovation and change† (p.70). In addition, meeting the need of such a vastly growing entity can be a difficult mission. Original limitations set forth by previous documents have been altered to reflect an even distribution of power and added protections for individuals. Due to the Texas constitution’s length of 63,000 plus words it is seen as one of the most verbose document of other states. According to Joe E. Four most frequent used are: Spherical: Smooth behavior at origin and more linear. Exponential: Greater slope than spherical i.e. relates to more random variables than spherical model. Gaussian: Using only Gaussian in absence of nugget can lead to problems in Kriging. Power: Also associated with fractal models. For above equations ‘h’ shows lag distance, ‘a’ is the practical range and ‘c’ is sill. There are three basic terms in all variograms; sill, nugget and range, as shown in figure 1. Sill is the value obtained after stabilizing the experimental curve by fitting a variogram model. It signifies ‘zero’ or no correlation of our spatial data, since variogram can be imagined as an inverse of variance graph, the sill shows the maximum variance i.e. there is no distance (zero lag) between the data, hence maximum correlation (for variance). Range is said to be the maximum distance for which correlation between 2 points can exist – beyond this autocorrelation cease to working – In terms of geology vertical range is greater than horizontal range due to difference in scale, ‘geometric anisotropy’. When comparing a horizontal variogram with vertical having different sills but same range one may conclude it as a ‘zonal anisotropy’, often due to stratification and layering. Range can also varies with type of model used. Based on the m odel equation figure 1 shows a manual attempt to demonstrate Gaussian model reaches sill (range is at lag 14) before exponential model having greater range (at lag 18). Range is said to be directionally dependent if anisotropy exist – geology is more anisotropic vertically than laterally. Nugget is an unavoidable error at origin in data. No correlation in data can lead to ‘Pure Nugget’, an ideal model have zero-nugget. For ease of understanding one can term it as an inherited error e.g. from measuring instruments. Figure 1 shows a nugget of 1.7732E-06. Noise can appear due to lack of data pairs and is more prominent in directional variogram, hence they do not show overwhelming evidence of anisotropy. Pure nugget models are also known as ‘white noise’ i.e. the data shows no spatial correlation. Interpreting Experimental Variogram (figure 1) For variogram or any other geostatistical method precision and optimality increases when the data is stationary and normally distributed i.e. mean and variance does not vary considerably. High deviation from data normality and stationary can result in complications. A skewed histogram influence the durability in estimation of variogram. Similarly if theoretical sill (see figure 1) is below experimental variogram a trend in data exist, which should be removed before interpreting the experimental variogram, however this does not mean it will solve the problem – no trend in dataset, see figure 2 (b). In other words geological data like porosity, grain size and permeability often shows trend which result in negative correlation as distance increases resulting in variogram to exceed sill (not in this case). Cyclicity (geological cyclicity) also known as hole-effect is another important phenomenon variograms exhibit (purple line, see figure 1). Periodic repeated variations like facies and other physical properties yield a cyclic behavior on variogram and like in figure 1 cause the variogram to deviate (below sill in this case). Cyclicity often diminishes over increasing distance as these periodic repeated geological variations are not consistent. This hole-effect phenomenon maybe insignificant in terms of overall variance but nonetheless should be included in a variogram’s interpretation. Table 1 shows the skewness as negative, however not perfectly skewed, however one can assume it due to lack of data since our range of measurement is only 39 f.t. Table 1 concludes our data is not perfectly normally distributed, hence our variogram model and Kriging will be affected significantly. Variograms such as rodograms or modograms or relative pairwise variograms are used when simple variograms fail to detect anisotropy and range. Amount if data is a big constraint in variogram modeling such that bigger the data, more accurate model. Spherical model fail to fit when lag distance exceed the practical range (like in our case). Lack of appropriate software and manual input of model equation in excel shows an approximate guide to how spherical, exponential and Gaussian model will behave. Gaussian model gives the best fit model and least nugget effect. A trend and sparseness in data greatly degrades the authenticity of variogram. Often biased especially when modelled inaccurately. Despite having its disadvantages a variogram can be a useful tool in heterogeneity analysis; an indicator variogram which converts the values into 1s and 0s is notably useful in quantification of lithological and geological units and future predictions. (Lieb & Miller 1988) According to (Stank & Crum 1997) the wastes that are eliminated are related to labour, where over staffing is a waste, time, in this case idle time or use of extra time to accomplish a goal is considered waste. Just in time concept emphasizes on customer requests and avoids making decisions based on forecast. In this concept, inventory is considered as an additional cost to the process. Traditionally, it would be considered to be value adding in the system. In this case, businesses and organisations are advised to eliminate any form of inventory that does not impact any additional value to the product. The just in time concept has various benefits to a business firm or enterprise. The benefits include an improvement in the flow of goods into, within and from the warehouse. There is also better planning and consistency in the organisation. Manpower can be reduced when production process has stopped mainly due to planned shut downs for maintenance, stocktaking activities, or any other reason (Stank & Crum 1997). This helps the enterprise to save on cost related to labour and other production overheads. When an organisation adopts the JIT concept and implements it, it helps in the production of better quality products and also increases the efficiency of production. All the aforementioned benefits are customer oriented. We therefore realise from the benefits customer satisfaction is enhanced. This in turn has an impact on customer loyalty and improved sales by the organisation. The net effect of this is improved profits by the organisation (Swamidass 2000). Despite having all the above benefits, the outcome of the terror attacks on September 11 has cast a lot of doubt on the just in time (JIT) concept deliveries in the supply chain. In a supply chain, each organisation along the chain depends upon a supplier and therefore in case of a hitch along the chain, the repercussions are felt along the whole chain. Before the September 11 attack the â€Å"JIT† was comfortably applicable and implemented to various businesses. Until this time, overstocking was avoided and components were delivered to the right place at the right time and in the right form with no hitch. Piling of inventory was avoided and production processes proceeded smoothly. However, the events of September 11 reversed all these, there were delays caused by grounding of aircrafts and also a longer time was required for border inspections. Transport on land was also highly affected. As an example, due to these interruptions, commodities destined for the Gap, Banana republic and the old navy stores ended up to a warehouse next to an airport. The business environment, both external and internal will always be fluctuating. External environment like the impact from natural calamities e. g. hurricanes, snow, storms, floods, earthquakes and internal environments like strikes, affect business operations. Therefore, for an organisation with a JIT system, in case of any fluctuation in the business environment, the supply chain will be disrupted and therefore flow of products downstream will not be realized (McClenahen & Jusko 2001). For a sudden change in the business environment, the shocks will be felt throughout the supply chain. There will be a gap that will be created along the chain at the point where the fluctuation is highly felt. It is a noble idea for businesses to consider having some safety stock on hand at each link of supply chain, which will take care of the emergencies in case of any eventuality. Since a supply chain consists of a network/series of suppliers and consumers, a hitch on one supplier side will affect the consumer who is also a supplier to the next consumer. Therefore in a business that has adopted the JIT system, it might end up being grounded because of lack of inventory to process or sell to the next stage of the chains. It is therefore highly recommended for such businesses to develop a Just in case system, a system that allows for a safety supplies that will take care of any eventualities. It is therefore worthy to mention that the JIT system will highly affect the style of operations in the logistics industry. The number of logistics service providers to be recruited will also be determined by the success of the JIT system. The quality of information that will be conveyed should also be put into consideration. The right information should be conveyed to the right place, at the right time and to the right person. The most applicable resources include e-procurement, e- marketing. e-banking and e-mailing. When an organisation conducts procurement via internet, a variety of goods both in terms of quality and quantity may be obtained. The business deal is also conducted in an accelerated speed. Marketing via the internet allows for the organisation to reach many customers within a very short time and hence improve on the organisation’s sales. Internet banking allows for faster business transactions hence delays associated with payments are reduced and therefore the supply chain is protected from such delays (Hale 1997).
